These terms govern your use of wholemindstrategy.com and the Faciliton workshop design application (collectively, the "Services"), operated by Whole Mind Strategy ("we," "us," or "our"). By using the Services, you agree to these terms.
Use of the Services
You may use the Services for lawful purposes related to professional development, workshop planning, and organizational strategy. You agree not to misuse the Services, including attempting to access them through automated means, interfering with their operation, or using them to harass, deceive, or harm others.
Accounts
Some features, including Faciliton, require you to sign in using a Google or Apple account. You are responsible for maintaining the security of your account and for all activity that occurs under it. We may suspend or terminate accounts that violate these terms.
AI-Generated Content
The Strategy Advisor chatbot, Faciliton's design tools, and the Real-Time Advice feature use artificial intelligence to generate suggestions, agendas, coaching profiles, and other content. This content is provided for informational and planning purposes only. AI-generated content may contain errors or omissions and should not be relied upon as professional advice. You are responsible for reviewing and adapting any AI-generated content before using it.
Faciliton generates an evolving facilitator coaching profile based on your workshop designs and post-workshop reflections. This profile — including assessments of your strengths, growth edges, and facilitation style — is generated by AI and represents automated observations, not professional coaching evaluations. It is intended to support your growth as a facilitator, not to serve as a formal assessment.
We do not guarantee the accuracy, completeness, or suitability of AI-generated content for any particular purpose. Use of AI-generated content is at your own discretion and risk.
Your Content
When you use Faciliton, you create and store workshop data including objectives, agendas, and related materials ("Your Content"). You retain ownership of Your Content. By using the Services, you grant us a limited license to store and display Your Content to you and to process it through our AI tools as part of providing the Services. We do not use Your Content to train AI models or share it with other users.
Intellectual Property
The Services, including all text, design, code, AI system prompts, the Whole Mind methodology, and the Faciliton application, are the intellectual property of Whole Mind Strategy. You may not copy, reproduce, distribute, or create derivative works from the Services without our written permission.
The workshop designs and content you create using Faciliton belong to you. Our methodology and the tools used to help you create them belong to us.
Payments and Purchases
Certain features require payment, including exercise expert guides, Workshop Day Passes (which temporarily increase your daily AI usage limit), and expert agenda reviews. Payments are processed by Stripe. All sales are final unless otherwise stated at the time of purchase. Prices are subject to change with notice. You agree to provide accurate payment information and authorize us to charge the amount indicated at checkout.
Usage Limits
Faciliton provides a free tier of AI-powered features subject to daily usage limits. These limits reset every 24 hours. Workshop Day Passes are available to temporarily increase your limit. We reserve the right to adjust usage limits at any time to ensure fair access and service stability.
Email Communications
If you opt in to email communications during onboarding or through your profile settings, we may send you facilitation tips, workshop reminders, and occasional updates about Faciliton and Whole Mind Strategy. We may also send automated emails triggered by your activity — such as follow-ups when you set workshop dates, reminders during agenda design, or post-workshop reflection prompts. These emails relate directly to workshops you are actively designing.
You can unsubscribe at any time by clicking the unsubscribe link included in every email, or by updating your email preferences in your Faciliton profile. We do not share your email address with third parties for marketing purposes.
Consulting Services
Facilitation, workshop design, and consulting engagements booked through the website are governed by separate agreements between you and Whole Mind Strategy. These terms apply to the website and Faciliton application, not to in-person consulting engagements.
Disclaimer of Warranties
The Services are provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not warrant that the Services will be uninterrupted, error-free, or free of harmful components. We disclaim all warranties including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
Limitation of Liability
To the fullest extent permitted by law, Whole Mind Strategy shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from your use of the Services. Our total liability for any claim arising from these terms or the Services shall not exceed the amount you paid us in the twelve months preceding the claim, or $100, whichever is greater.
Indemnification
You agree to indemnify and hold harmless Whole Mind Strategy from any claims, damages, or expenses arising from your use of the Services, your violation of these terms, or your violation of any rights of a third party.
Modifications
We may update these terms from time to time. Changes will be posted on this page with an updated revision date. Continued use of the Services after changes are posted constitutes acceptance of the revised terms.
Termination
We may suspend or terminate your access to the Services at any time for violation of these terms or for any other reason at our discretion. You may stop using the Services at any time. Upon termination, your right to use the Services ceases, though provisions that by their nature should survive (such as limitations of liability and indemnification) will remain in effect.
Governing Law
These terms are governed by the laws of the State of Colorado, without regard to conflict of law principles. Any disputes arising from these terms or the Services shall be resolved in the courts of the State of Colorado.
